1. About WebWill

WebWill ("we", "us", "our") provides a free online questionnaire service that helps individuals in England and Wales draft a Last Will and Testament. We also offer an optional paid document storage service.

Our service is available at webwill.co.uk and is intended for use by individuals aged 18 and over who are resident in England and Wales.

2. Eligibility

To use our service you must:

• Be aged 18 or over
• Be of sound mind and mental capacity
• Be resident in England or Wales (our Will template is drafted under English and Welsh law)
• Not be acting under duress or undue influence

If you are resident in Scotland or Northern Ireland, the law governing Wills differs significantly. Our document may not be valid in those jurisdictions and you should seek specialist legal advice.

3. Nature of Our Service

WebWill provides a document drafting tool only. We are not:

• A law firm or firm of solicitors
• Regulated by the Solicitors Regulation Authority (SRA)
• Providing legal advice
• Providing estate planning advice

The Will document generated by our questionnaire is based on the information you provide. We cannot verify the accuracy or completeness of that information. It is your responsibility to ensure that all information entered is correct and that the resulting document accurately reflects your wishes.

4. The Will Document

The Will document generated by our service:

• Is drafted for use in England and Wales under the Wills Act 1837
• Must be signed and witnessed correctly to be legally valid (see the signing instructions provided with your document)
• Will not be legally binding until it has been correctly signed in the presence of two eligible witnesses
• Should be reviewed by a solicitor if your circumstances are complex

Signing requirements: Your Will must be signed by you in the presence of two witnesses, both present at the same time. Both witnesses must then sign in your presence. Witnesses must be aged 18 or over and must not be beneficiaries under the Will or the spouse or civil partner of a beneficiary.

Failure to execute your Will correctly will render it invalid.

5. Your Responsibilities

When using our service, you agree to:

• Provide accurate and complete information in the questionnaire
• Not use the service on behalf of another person without their explicit consent
• Keep a signed copy of your Will in a safe and accessible location
• Inform your executors of the location of your Will
• Review and update your Will when your circumstances change (marriage, divorce, new children, significant changes in assets)
• Not use our service for any fraudulent or unlawful purpose

6. Document Storage Service

We offer an optional paid document storage service. By purchasing this service you agree that:

• Storage fees are charged as stated at the time of purchase (monthly or annual subscription)
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• We will store a certified copy of your Will document securely
• We are not responsible for any losses arising from our inability to locate or produce a stored document where that failure results from circumstances beyond our reasonable control
• Payments are processed by Stripe and are subject to Stripe's terms of service

7. Limitation of Liability

To the fullest extent permitted by law:

• WebWill shall not be liable for any loss or damage arising from reliance on the Will document generated by our service without obtaining independent legal advice
• We shall not be liable for any indirect, consequential, or special losses
• Our total liability to you shall not exceed the amount paid by you for our services in the 12 months preceding any claim
• We do not exclude or limit liability for death or personal injury caused by our negligence, fraud, or any other matter which cannot be excluded by law

8. Intellectual Property

All content on webwill.co.uk, including the questionnaire design, document templates, and software, is the intellectual property of WebWill. You may not copy, reproduce, or distribute any part of our service without our prior written consent.

The Will document generated for you is your personal document and you are free to use it as you wish.

9. Privacy

Your use of our service is also governed by our Privacy Policy, which explains how we collect, use and protect your personal data. By using our service, you consent to the processing of your data as described in that policy.

10. Availability of Service

We aim to keep WebWill available at all times but do not guarantee uninterrupted access. We may need to temporarily suspend the service for maintenance or technical reasons. We will not be liable for any inconvenience or loss arising from service interruptions.

11. Changes to These Terms

We may update these Terms of Use from time to time. We will post the updated terms on our website with a revised "last updated" date. Your continued use of our service after any changes constitutes acceptance of the new terms.

12. Governing Law

These Terms of Use are governed by the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
